By creating an account, placing an order or using any service, you accept these Terms together with the سياسة الاستخدام المقبول, سياسة الخصوصية, Refund Policy, Service Level Agreement و سياسة النطاقات (together, the “Agreement”).
1. Eligibility and account
- You must be at least 18 years old and legally able to enter into contracts. If you act for a company, you confirm you are authorised to bind it.
- You must provide true, complete and current information, and keep it updated. Accounts opened with false, incomplete or third-party information may be suspended or closed without refund.
- You are responsible for all activity under your account and for keeping your credentials, API keys and two-factor devices secure. Notify us immediately of any unauthorised use.
- One natural or legal person per account. Accounts may not be sold or transferred without our written consent.
2. Identity verification
- To prevent fraud, spam and illegal activity, we verify every customer before activating services. Verification includes email confirmation, a code sent to your mobile number via WhatsApp, a valid identity document and proof of address. For .om domains and OV/EV certificates we may require a commercial registration and other documents demanded by the registry or certificate authority.
- We may request further documents at any time, including after activation, and may refuse, suspend or cancel an order where verification fails, documents appear altered, or the information does not match payment details.
- Orders that remain unverified 14 days after payment may be cancelled; any refund is made to the original payment method, less non-recoverable third-party costs.
3. Orders, prices and payment
- Prices are shown in Omani Rial (OMR). If we become VAT-registered, VAT will be added at the applicable rate from the effective date. Promotional prices apply to the first term only; renewals are charged at the renewal price shown at the time of order.
- Services are provided on a prepaid basis. An order is accepted only when payment has cleared and verification is complete.
- Recurring services renew automatically for the same term unless cancelled from the client area before the renewal invoice due date. We issue renewal invoices in advance and send reminders by email.
- Unpaid invoices may lead to suspension five (5) days after the due date and termination with deletion of data thirty (30) days after the due date. We are not liable for data lost after termination for non-payment.
- Chargebacks or payment reversals without first contacting us are treated as a material breach; affected services are suspended and a handling fee of OMR 10 may apply.
- We may change prices for future terms with at least thirty (30) days’ notice by email.
4. Our services
- We provide shared hosting, application hosting (including Node.js, Python and AI-agent servers), virtual private servers, domain registration, SSL certificates and related add-ons as described on our website at the time of order.
- “Unlimited” or “unmetered” resources are offered under fair use for normal website operation and do not permit file storage, backups of other systems, media streaming or uses that degrade service for other customers. We may ask you to upgrade or limit usage that exceeds typical use.
- Third-party software (for example cPanel, Plesk, CloudLinux, WordPress, Claude Code, Codex CLI, n8n) is provided under its own licence. AI Agent Hosting does not include access to any third-party AI service; you supply your own API keys and are responsible for your use of those services and their terms.
- Domain names and SSL certificates are supplied through accredited registrars, registries and certificate authorities, whose policies form part of this Agreement for those services.
5. Your responsibilities
- You are solely responsible for all content, data, software and communications you or your end-users place on or transmit through the services (“Customer Content”), and for their legality, including under the Cybercrime Law (Royal Decree 61/2026), the Personal Data Protection Law (Royal Decree 6/2022), the Electronic Transactions Law (Royal Decree 39/2025), copyright and trademark laws, and — where you or your audience are in the UAE — Federal Decree-Law No. 34 of 2021 and Federal Decree-Law No. 45 of 2021.
- Where your website collects personal data, you act as the data controller and must publish your own privacy notice and obtain any consents required by law.
- You must keep your software (CMS, plugins, themes, libraries, operating system on a VPS) updated and secure. You are responsible for damage caused by compromised accounts or vulnerable software you install.
- Backups. Backups we provide are a courtesy unless you purchased a backup add-on, and even then do not replace your own. You must keep independent copies of your data.
- On a VPS or AI-agent server you have full administrative control and are responsible for its security, configuration, firewall, updates and all activity on it, including actions taken by AI agents or automated software you run.
6. Monitoring, suspension and cooperation with authorities
- We do not routinely monitor Customer Content, but we use automated tools (malware scanning, spam filtering, resource and network monitoring) to protect our infrastructure and other customers.
- We may suspend or restrict any service immediately, with or without notice, where we reasonably believe: the Agreement or the Acceptable Use Policy is breached; the service is compromised or is attacking others; continued operation risks legal liability, harm to third parties or to our network; we are required to do so by a court, a competent authority (including the Telecommunications Regulatory Authority, the Cyber Defence Centre or the Royal Oman Police) or by law; or payment is overdue.
- We will disclose information or content to competent authorities where required by applicable law or a valid order, and may preserve data relevant to an investigation.
- Suspension does not suspend your obligation to pay. Repeated or serious violations lead to termination without refund.
7. Intellectual property
You keep all rights in Customer Content and grant us only the limited licence needed to host, back up, transmit and display it to provide the services. Our website, software, brand and documentation remain our property or that of our licensors.
8. Service levels and warranties
- Our uptime commitment and the sole remedies for missing it are set out in the Service Level Agreement.
- Except as expressly stated in the Agreement and to the extent permitted by law, the services are provided “as is” and “as available”. We do not warrant that the services will be uninterrupted or error-free, or that they meet your particular requirements.
9. Limitation of liability
- To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, or for loss of profit, revenue, business, goodwill, data or anticipated savings, however caused.
- Our total aggregate liability arising from or relating to the Agreement in any twelve (12) month period is limited to the fees you actually paid for the affected service during the three (3) months before the event giving rise to the claim.
- Nothing in the Agreement limits liability that cannot be limited under the laws of the Sultanate of Oman, including liability for fraud or wilful misconduct, or rights you have as a consumer under the Consumer Protection Law (Royal Decree 66/2014) that cannot be waived.
10. Indemnity
You will indemnify and hold harmless SafaHost, its owners, employees and suppliers against all claims, fines, losses and costs (including reasonable legal fees) arising from Customer Content, your use of the services, your breach of the Agreement or your violation of any law or third-party right.
11. Term, cancellation and termination
- You may cancel any service from the client area or by ticket. Cancellation takes effect at the end of the paid term unless you request immediate cancellation; refunds are governed by the Refund Policy.
- We may terminate the Agreement for convenience with thirty (30) days’ notice and refund unused prepaid fees pro rata, or immediately for material breach as described above.
- After termination, data is deleted from our systems within thirty (30) days, except where we must retain it by law.
12. Force majeure
We are not responsible for failure or delay caused by events beyond our reasonable control, including natural disasters, war, regional conflict, government action, power or telecommunications failures, large-scale cyber-attacks, or failures of upstream providers.
13. Changes
We may update the Agreement. Material changes are announced by email or in the client area at least fourteen (14) days before they take effect. Continued use after that date means you accept the changes; if you do not agree, you may cancel the affected services before the effective date.
14. Notices and electronic communications
You agree to receive notices electronically at the email address on your account. Electronic records and acceptance through our website have the same legal effect as signed documents, in accordance with the Electronic Transactions Law.
15. Governing law and disputes
- The Agreement is governed by the laws of the Sultanate of Oman.
- The parties will first try to resolve any dispute amicably through a written complaint to [email protected]; we respond within fifteen (15) working days.
- Failing amicable resolution within thirty (30) days, the competent courts of Muscat, Sultanate of Oman have exclusive jurisdiction, without prejudice to any mandatory consumer rights to bring a complaint before the Consumer Protection Authority.
16. Language and miscellaneous
This Agreement is written in English; an Arabic translation is available on request. Where applicable Omani law requires the Arabic text to prevail, it prevails. If any provision is held invalid, the rest remains in force. Our failure to enforce a provision is not a waiver. You may not assign the Agreement without our consent; we may assign it to an affiliate or successor.
